Horse Trailer Use Agreement
Purpose and Intended Use:
- Designed for horse trailer owners who lend their trailer to others to use free of charge.
- Can be used for one-time use of a horse trailer or regular/recurring use.
- Can be used for any type of horse trailer, from single-horse bumper pull trailers to large horse trailers with living quarters.
- Not intended for situations where there will be a fee charged for use of the horse trailer (see ELS’ Horse Trailer Rental Agreement).
- Horse Trailer Use Agreement and associated instructions.
- Description of the trailer being used, including current market value and number of horses it is designed to haul.
- Identification of existing functional and cosmetic defects; owner warrants that the defects will not affect safe use of the trailer (unless otherwise noted).
- User agrees to pay for any damage to the trailer during use.
- Owner can specify requirements and restrictions for use of the trailer.
- User agrees to perform all steps identified in provided checklists prior to use and return of the trailer.
- User must have a valid driver’s license, adequate insurance and any special license endorsements required to legally tow the trailer.
- User agrees not to sue the trailer owner (and certain related parties) in connection with use of the trailer.
- User agrees to pay the trailer owner’s legal fees if the owner is sued in connection with the user’s use of the trailer.
Horse Trailer Rental Agreement
- Designed for horse trailer owners who rent their trailer to others for a fee.
- Can be used for one-time horse trailer rentals or regular/recurring rentals.
- Can be used for any type of horse trailer, from single-horse bumper pull trailers to large horse trailers with living quarters.
- Not intended for situations where there is no fee charged for use of the horse trailer (see ELS’ Horse Trailer Use Agreement).

- Description of the trailer being rented, including current market value and number of horses it is designed to haul.

- Renter agrees to pay for any damage to the trailer during use.
- Owner can specify requirements and restrictions for use of the trailer.
- Renter agrees to perform all steps identified in provided checklists prior to use and return of the trailer.
- Renter must have a valid driver’s license, adequate insurance and any special license endorsements required to legally tow the trailer.
- Renter agrees not to sue the trailer owner (and certain related parties) in connection with use of the trailer.
- Renter agrees to pay the trailer owner’s legal fees if the owner is sued in connection with the user’s use of the trailer.
